On a16z crypto podcast, the CLARITY Act debate circled back to one big uncomfortable question that ‘could clearer rules have made another FTX-style collapse less likely?’ As per comments from the August 1st podcast, the answer was mostly ‘yes’ at least when it comes to oversights, audits, and accountability for crypto exchanges.

The discussion resurfaced today on August 6th after Wu Blockchain shared an excerpt from the podcast, where a16z crypto outlined how the proposed legislation could reshape the regulatory landscape for digital assets in the United States.

Why CLARITY Act Matters For Crypto Exchanges

During the conversation, it was argued that the US still lacks a comprehensive federal regulatory framework for crypto exchanges. While traditional financial markets operate under established oversight, crypto trading platforms currently don’t have a similar nationwide structure.

According to the discussion, the CLARITY Act would assign oversight responsibilities to both the SEC and the CFTC while introducing disclosure requirements, anti-fraud provisions, insider trading rules, and mainly audit obligations for crypto intermediaries.

The broader objective, as described in the podcast, is to create long-term regulatory certainty for exchanges, institutions, entrepreneurs, and consumers rather than relying on shifting agency guidance.

FTX Collapse Remains Central To The Debate

The collapse of FTX remained one of the strongest examples used during the discussion. It was argued that if crypto exchanges had already been operating under regulatory standards similar to traditional financial institutions that include audits, compliance programs, and risk controls, then the odds are high that the likelihood of similar failures could have been significantly reduced.

The podcast also highlighted that the proposed framework would require federally registered crypto exchanges to operate under defined compliance standards. Platforms failing to meet those requirements would not be permitted to freely operate in the United States.

Alongside FTX, the discussion also referenced Terra-Luna as another example of why clear regulatory framework matter, noting that stablecoins without proper backing would not comply with the existing GENIUS framework.

Regulatory Certainty Seen As Industry Foundation

Beyond investor protection, the speakers argued that regulatory clarity is becoming increasingly important as stablecoins, tokenized assets, and blockchain infrastructure gain broader institutional adoption.

The discussion noted that legislation provides stronger long-term certainty than agency guidance alone, giving businesses confidence to build products that may take years to develop.

According to the podcast, the CLARITY Act is intended to provide that stable foundation by defining regulatory responsibilities, strengthening market safeguards, and creating rules that compliant crypto businesses can follow over the long-term.

Whether the legislation ultimately passes remains a question and is still uncertain, but the debate continues to focus on one recurring theme, where clear rules might not be able to eliminate every possible failure, yet supporters to the CLARITY Act bill argue they can at least make catastrophic collapses far less likely.
