Grayscale Bitcoin Trust ($GBTC) has sent a high-stakes letter to the Securities and Exchange Commission (SEC). Following a court decision that rebuffed the SEC’s previous denial of Grayscale’s ETF plans, the investment giant has shot off an incisive letter to the regulatory body. 

The Unresolved Question

They argue that if there were any legitimate reasons, especially under the Exchange Act’s rule to mitigate fraudulent activities, it would have emerged during the series of 15 Commission orders rejecting spot bitcoin Rule 19b-4 filings. With this bold inquiry, Grayscale is essentially daring the SEC to justify its regulatory practices.
