SEC, Kraken accusing the exchange of operating an unregistered securities exchange, U.S. District Judge William H. Orrick said in federal court in San Francisco:
“SEC“It has plausibly alleged that at least some of the cryptocurrency transactions that Kraken facilitates on its network constitute investment contracts and therefore securities and are accordingly subject to securities laws.”
The SEC, which claims that most altcoins are securities, investment contracts, has gained the opportunity to continue the case at this point. The court believes that the lawsuit filed is justified, assuming that there will be assets on the Kraken exchange that the SEC can prove are securities.
